Terms of Use Agreement

This Terms of Use Agreement (the "Agreement") is entered into by and between The Backyard Shop (hereinafter referred to as "The Shop") and the undersigned individual (hereinafter referred to as "Member") for the use of the facilities, tools, and equipment provided by The Shop.

1. Access and Shop Hours:

The Member is granted access to The Shop during designated "Shop Open Hours." Additionally, access may be granted outside of these hours with advanced notice provided to The Shop's management. The Shop reserves the right to modify Shop Open Hours with reasonable notice.

2. Shop-Keeping:

a. Members shall maintain the workspace in a clean, organized, and hazard-free condition, adhering to all safety standards.

b. Each Member is required to diligently and securely store tools and equipment after use.

c. Any damages, malfunctions, or safety concerns regarding equipment must be promptly reported to The Shop's management.

3. Communal Equipment Use:

a. Members are obligated to employ communal tools and equipment in a judicious and safe manner, strictly observing all safety guidelines.

b. Priority for tool and equipment use is afforded to Members who have pre-scheduled their usage.

c. Members shall accord due respect to the projects of others and abstain from interference with ongoing work.

4. Good Behavior:

a. Members shall comport themselves in a professional, respectful, and courteous manner at all times.

b. Noise levels shall be kept at a minimum to maintain a cooperative and positive atmosphere within The Shop.

c. Members shall strictly adhere to all safety guidelines and instructions as provided by The Shop's management.

5. Liability and Waiver:

a. The Member expressly acknowledges and assumes all risks and responsibilities associated with their activities in The Shop, recognizing the inherent hazards inherent in the use of tools and equipment.

b. The Shop bears no liability for any injuries, damages, or losses incurred by the Member or their guests, including but not limited to personal injury, property damage, or theft.

c. Members must execute a separate, comprehensive liability waiver before accessing The Shop's facilities, absolving The Shop from any and all claims.

6. Member Responsibilities:

a. Members are solely responsible for their individual projects, tools, and materials brought into The Shop.

b. The Shop assumes no responsibility for the loss, damage, or theft of personal belongings belonging to Members.

7. First Aid and Emergency Procedures:

a. Members are encouraged to familiarize themselves with the location of first aid kits and emergency exits within The Shop.

b. In the event of an emergency, Members shall adhere to established safety protocols and immediately inform The Shop's management.

8. Membership Termination:

a. Membership is revocable at the discretion of either party, with or without cause.

b. The Shop reserves the unequivocal right to deny or terminate membership for violations of this Agreement, disruptive behavior, or unsafe practices.

c. In the event of termination, Members shall promptly cease utilization of The Shop's facilities and equipment.

9. Trespassing:

a. Upon termination of membership, Members are explicitly prohibited from entering The Shop's property without explicit written permission from The Shop's management.

b. Trespassers may be subject to legal action.

10. Changes to Terms:

The Shop reserves the right to amend these terms with reasonable notice. Continued use of The Shop's facilities after such modifications shall constitute acceptance of the revised terms.

By executing this Agreement, the Member unequivocally affirms that they have thoroughly read, comprehended, and willingly agreed to adhere to the terms and conditions delineated herein.
